Insurance, recovery/compensation
Insurance
The qualified insurance specialist member of our Law Office has professional experience of several decades in insurance–related individual disputes as well as in the preparation of insurance contract documents for insurance companies. Based on the aforesaid, we participate in non–litigious discussions and litigious settlement or enforcement of insurance claims, regress cases and the preparation and interpretation of documentation of insurance products, contracts and policies as well as in drafting internal regulations of insurance brokers.
We undertake the representation of insured parties against insurers in matters of interpreting insurance contracts, render opinions as to whether an event qualifies as sufficient to serve as basis for a claim; and provide legal services in premium–related disputes.
Compensation
We gained significant experience through our practice on both sides of claim pursuance matters with or without litigation in cases of personal injury and loss of assets:
- In connection with claims arising from vehicle liability insurance,
- In connection with property insurance claims (own fault liability, company/industrial assets policies or home insurances regarding the services of insurers;
- Medical malpractice matters,
- Occupational accidents;
- Product liability;
- Claims arisen in connection with pharmaceutical products;
- Enforcement of neighbours’ rights;
- Construction–related compensation claims;
- Enforcing liability claims from sources other than the above;
- Contractual claims pertinent to life, accident and sickness insurances;
- Representing regress claims of insurers.
We have been in cooperation for several years with forensic medical, architect, real estate, and graphologist experts whose assistance may be invaluable in certain matters.
• Representing the insured before the insurer where an insured event occurred, and providing assistance in the compilation of evidence to be submitted to the insurer;
• Representing the insured party of a liability insurance not only before the insurer but also before the party who incurred the loss;
• Counselling in litigious matters related to the above.
• Assessment of the opportunity of successful claim enforcement as soon as after the first conference in medical malpractice matters (i.e. whether the claim can be successfully enforced and if so, how)
• Putting together compensation claims (a petition, if needed) and representing the client before the insurer or the party who caused the loss;
• Our primary goal is to close the enforcement efforts by a preferable settlement agreement,
• Counselling in litigation related to the above.
• Legal support in non–litigious processing of claims (assessment of legal grounds, determination of insurance sums);
• Counselling for insurers in lawsuits against insured parties, and claimants as well as in actions aimed at the enforcement of regress claims or commission claims of brokers.
• Counselling against insurers in litigious and non-litigious disputes.
